The government let certain types of public procurement be done without open tenders

The relevant draft law lets public procurement happen in certain cases without open bidding.

 The Cabinet of Ministers has adopted a resolution amending the peculiarities of public procurement of goods, works, and services for customers provided for by the Law of Ukraine “On Public Procurement” for the period of martial law in Ukraine and within 90 days from the date of its termination or cancellation.

This document allows for goods, works, and services to be bought without open bidding in certain cases:

1) Taking steps to protect the facilities of businesses, organizations, and institutions in the electric power, nuclear, coal, oil, and gas industries, as well as critical infrastructure facilities in the railway transport sector of the transport and postal industry.

2) Fixing and fixing up equipment in line with a joint venture agreement between Ukrzaliznytsia and the government (the agreement was made to improve the country’s defense capability during martial law).

3) To guarantee the construction of military engineering and fortification structures, mobilization tasks, activities related to the preparation and execution of territorial defense tasks, and the execution of contracts containing restricted information, if such procurement is carried out for the needs of the Armed Forces, other military formations, law enforcement agencies, the State Emergency Service, higher military educational institutions at their reasonable request, with the subsequent transfer of such goods, works and services to the requestor’s records.

The document was created based on the findings of the study of life support issues in the frontline areas, initiated by Prime Minister Denys Shmyhal.

The Ministry of Economy collaborated with the Ministry of Reintegration, frontline regional military administrations, and communities on the project.
