Formation of a unified list of territories where military operations are (were) conducted or temporarily occupied by the Russian Federation

In order to determine the mechanism for the formation of a single list of territories in which hostilities are being (were) conducted or temporarily occupied by the Russian Federation, the Cabinet of Ministers of Ukraine adopted Resolution No. 1364 “Some Issues of Forming the List of Territories in Which Hostilities are Being (Were) Conducted or Temporarily Occupied by the Russian Federation” of December 06, 2022 (hereinafter – the Resolution).

In accordance with paragraph 1 of the Resolution, the list of territories in which hostilities are being (were) conducted or temporarily occupied by the Russian Federation (hereinafter – the List) is approved by the Ministry of Reintegration of the Temporarily Occupied Territories in coordination with the Ministry of Defense on the basis of proposals from the relevant regional and Kyiv City Military Administrations.

Order of the Ministry of Reintegration No. 309 of December 22, 2022, based on proposals from the relevant regional military administrations, approved the list of territories where hostilities are being (or have been) conducted or temporarily occupied by the Russian Federation.

The list includes two categories of hostilities on the territory: active and possible. A separate section of the list defines the occupied territories. In addition, the list retrospectively includes territories where hostilities were conducted and temporarily occupied since February 24, 2022, and where hostilities or temporary occupation have ended.

It is important to note that the aforementioned List is scalable to the level of individual settlements. This principle of formation will allow for more effective resolution of the issue of restoring access to the registers. It will also add flexibility in determining whether or not a certain territory belongs to the temporarily occupied territories.

The list will be used, in particular, for payments to internally displaced persons, privatization of state property, simplified admission to educational institutions, restriction and restoration of access to public electronic registers, etc.
