The Department for the Protection of the Rights of Citizens Affected by Armed Aggression consists of four divisions:
- the Department for Support of Liberated Defenders of Ukraine
- the Department for Human Rights and Illegally Detained Persons
- Sanctions policy department
- Analytics department
The main tasks of the Department for the Protection of the Rights of Citizens Affected by Armed Aggression are:
- ensuring the formation and implementation of the state policy on the temporarily occupied territories of Ukraine and protection of the rights of the population living there, the ultimate goal of which is their reintegration into the single constitutional space of Ukraine;
- participation in the formation and implementation of state policy on the protection of the rights and freedoms of persons violated as a result of the temporary occupation of a part of the territory of Ukraine or loss of control over a part of it;
- promoting the realization of the rights and freedoms of Ukrainian citizens residing in the temporarily occupied territories of Ukraine and adjacent territories.
Department in accordance with the tasks assigned to it:
- collects and systematizes information on violations of the rights of Ukrainian citizens, foreigners and persons without citizenship, including those deprived of their personal liberty as a result of the actions of illegal armed groups, the occupation administration and/or the authorities of the Russian Federation in the temporarily occupied territory;
- takes measures to protect the rights, freedoms and legitimate interests of individuals and legal entities that have been violated as a result of the armed conflict and/or temporary occupation of part of the territory of Ukraine;
- prepares and submits to the Cabinet of Ministers of Ukraine proposals for the application, abolition and amendment of special economic and other restrictive measures (sanctions) that are submitted by the Cabinet of Ministers of Ukraine to the National Security and Defense Council of Ukraine in accordance with the Law of Ukraine “On Sanctions”, and participates in the formation, implementation and monitoring of the effectiveness of the state sanctions policy on issues within its competence;
- coordinates the implementation of measures to protect and ensure the rights and interests of persons deprived of their personal liberty as a result of the actions of illegal armed groups, the occupation administration and/or authorities of the Russian Federation in the temporarily occupied territories of Ukraine, as well as members of their families;
- ensures, in accordance with its competence, the implementation of measures for the transfer of prisoners of war of the enemy to the aggressor state and the release of defenders of Ukraine who are in captivity of the aggressor state, in particular, coordinates the activities of regional state administrations (regional military administrations) to provide released defenders of Ukraine and other released persons with basic necessities;
- submits to the Cabinet of Ministers of Ukraine a proposal for a state-owned enterprise to perform the functions of the National Information Bureau in accordance with the Geneva Convention on the Treatment of Prisoners of War and the Geneva Convention on the Protection of Civilian Persons in Time of War of August 12, 1949;
- ensures the functioning and interaction of the National Information Bureau with state bodies, the International Committee of the Red Cross, and controls the activities of the said Bureau;
- ensures coordination of the activities of central and local executive authorities and other state bodies on the organization of work with prisoners of war during a special period;
- promotes, in accordance with the procedure established by law, the social rehabilitation of persons who have been deprived of their personal freedom as a result of the actions of the armed forces of the Russian Federation, the occupation administration and/or state bodies of the Russian Federation in the temporarily occupied territory;
- interacts with international organizations, in particular the UN, OSCE, Council of Europe, International Committee of the Red Cross and their structures, relevant bodies, and non-governmental organizations of foreign countries, international non-governmental organizations, public associations, and the media to ensure the observance and protection of human rights in the temporarily occupied territory;
- promotes scientific research with the involvement of domestic and international experts on issues within the competence of the Department.
